Acceptable use of Services

This Acceptable Use Policy (“AUP”) describes how you must use and what you cannot do with the MyCalling Solution ad any other services which we may provide to you (collectively the “Services”).

You are solely responsible for: (i) the content, materials and data that you upload to and process on the Services; (ii) the content, materials and data that you create through your use of the Services; and (iii) any applications and other software that you install or run on the MyCalling Solution (together “Customer Content”).

This AUP applies to all uses of any Services including use resulting from or involving Customer Content.

You will comply with all applicable laws and regulations when using the Services and will not allow any illegal or improper use of the Services.

Changes to AUP

We may change this AUP from time to time by posting the updated version of this AUP to https://mycalling-internal.limabean.co.za/aup or otherwise providing notice to you. If you do not agree with the change you must stop using the Services. If you continue to use the Services following a change to this AUP you will be deemed to have accepted the change.

AUP applies to all Users

This AUP applies to the use of the Services by all your users, third party service providers and other end-users who you may give access to (“Users”). You are responsible for the acts and omissions of all Users.

Usage Limits

Materials uploaded to the Services may be subject to posted limitations on usage, reproduction, or dissemination. You are responsible for adhering to such limitations if you download such materials.

You may not circumvent any limits that we place on your use of the Services.

Abuse and Illegal Behaviour

You agree to use the Services only to post, send, and receive messages and materials that are proper and, when applicable, related to the particular Service. If you choose to share materials or solutions with others using a Service, you agree that you are giving a license to all users of the Service, including the rights to use, modify, and repost such materials or solutions, and you are allowing us to make them available to such users in a manner and location of our choosing. In using the Services, you may not:

• use the Services in connection with surveys or contests (except and to the extent offered by us, our partners, or our customers through the Services), pyramid schemes, junk email, spamming, or any duplicative or unsolicited messages (commercial or otherwise);
• defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
• publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, obscene, indecent, sexist, racist or unlawful topic, name, material or information;
• upload, or otherwise make available, files that contain images, photographs, software, or other material protected by intellectual property laws, including, by way of example and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same;
• use any material or information, including images or photographs, which are made available through the Website Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
• upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property;
• advertise or offer to sell or buy any goods or services for any business purpose, unless a Service specifically allows such messages;
• download any file posted by another user of a Service that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, or distributed in such manner;
• falsify or delete any copyright management information, such as author attributions, legal or other proper notices, or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
• restrict or inhibit any other user from using and enjoying the Services;
• violate any code of conduct or other guidelines that may be applicable for any particular Service;
• harvest or otherwise collect information about others, including e-mail addresses;
• violate any applicable laws or regulations;
• create a false identity for the purpose of misleading others; or
• use, download, or otherwise copy or provide (whether or not for a fee) to a person or entity any directory of users of the Services or other user or usage information or any portion thereof.

Security

You may not use the Services or allow the Services to be used to: (a) gain unauthorized access to computer systems or engage in security attacks of any kind including: (i) against trust (such as email spoofing (impersonating someone else), password cracking, IP spooking and DNS poisoning); (ii) against confidentiality and integrity (by using malware such as computer viruses, worms, trojan horses, rootkits, keyloggers, spyware or other malicious programs and code); or (iii) against availability (such as denial of service and email bombs); (b) corrupt, modify or intercept electronic communications intended for any other person or entity; or (c) interfere with or disrupt the operation of the Services.

Law Enforcement

We reserve the right at any time and without notice to investigate any suspected breach of this AUP or misuse of our Services.

We may block access to Customer Content or remove it from the Services if we have reasonable grounds to suspect that it breaches this AUP.

We may be required to cooperate with courts and judicial bodies, police and law enforcement authorities, regulators and other appropriate third parties to help with the investigation and prosecution of illegal conduct. This cooperation may include disclosing information and data about the Services to them and providing them with information about your use of the Services and Customer Content when we are legally required to do so.

Suspension or Termination

If you breach this AUP or misuse the Services or allow others to do so, we may suspend or terminate your use of the Services.

If we decide that the breach can be remedied without suspending your access to the Services, we will request you to remedy the breach within the time period that we specify. If the breach is not remedied within that time period, we reserve the right to suspend your access to the Service.

If we suspend your access to the Service, we may terminate your access to the Service if you do not correct the reason for suspension within seven days of the suspension.

Reporting Breaches

You will immediately notify us if you become aware of any breach of this AUP and assist us to investigate or remedy the breach.

We have no obligation to monitor the Services. However, we reserve the right to review materials posted to the Services and to remove any materials in our sole discretion.

Always use caution when giving out any personally identifiable information about yourself in any Services. We does not control or endorse the content, messages, or information found in any Services and, therefore, we specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services.
